Terms and conditions for bicycle tours

The following terms and conditions must be read and agreed to before booking any tour with Yellow Velo Inh. Peacock. The customer declares on behalf of him/herself, on behalf each person who is detailed in the booking, that they understand and agree to the following statements.

Tour participants should be physically fit, and to the best of their knowledge, without injury or illness. Tour participants should inform Yellow Velo Inh. Peacock of any known pre-existing injuries or illness before commencing a tour. In this case it will be at the discretion of the tour guide as to whether participation is possible. Refunds will not be made in cases where the guide decides that someone may not participate based on pre-existing injury or illness. Please get in touch before booking a tour if you are unsure whether this applies to you.
All participants must be over the age of 10 years and able to confidently operate a bicycle with multiple gears. Children must be able to keep up with a group of adults travelling at a steady pace for the full tour distance. The tour guide has the right to ask tour participants to sit out the remainder of the tour if the participant is deemed to be holding up the rest of the tour group. In this case no refunds will be made. If the customer is in any way unsure about the tour requirements, they should ask for guidance before booking a tour.
Tour participants are required to exercise due care when handling the equipment provided by Yellow Velo Inh. Peacock, and return the equipment without damage or defect. In case of damage or defects being caused to equipment by the tour participant during the tour, the Terms and Conditions agreement contract signee is liable for the full cost of the replacement items and necessary repairs, including the labour costs (repairs charged at chf 100 per hour). The signee is also solely responsible for any losses or damage incurred to the equipment used by those legally represented by them in the agreement contract.
Tour participants, or those legally representing them, accept the risks associated with the use of a bicycle. Riding on public roads and on varying terrains and in varying weather conditions inherently involves risks. Explanations and instructions given by staff and guides from Yellow Velo Inh. Peacock, prior to and during the tour, must be listened to and followed by each tour participant. Each tour participant is solely responsible for being aware of and adhering to the traffic regulations in Switzerland.
For all bicycle tours conducted by Yellow Velo Inh. Peacock, the tour participant must agree to the wearing of a bicycle helmet.
Each tour participant should maintain sufficient insurance coverage for potential risks related to bicycle use. Customer accident insurance or insurance for any damages caused by the customer during the tour, whether to the equipment provided by Yellow Velo Inh. Peacock or to a third party, is not covered by Yellow Velo Inh. Peacock. Liability of Yellow Velo Inh. Peacock and its staff is not accepted so far as is permitted by Swiss law. In all other cases, the liability of Yellow Velo Inh. Peacock is limited to the fees paid by the customer.

Tour Weather Conditions

We can run our bike tours in many weather conditions, such as rain and snow. In the event of unsafe weather conditions, such as storms, strong winds, deep snow or hail, the tour will be cancelled by Yellow Velo Inh. Peacock. In such cases the customer will be contacted and either rescheduled if possible or refunded in full.

In the event of mildly adverse weather conditions such as rain the tour will still go ahead. However if they wish, the customer may request to reschedule to a new date. In this case rearrangements may or may not be made, this will be at the discretion of Yellow Velo Inh. Peacock and will largely depend on the availibilty of tour spaces and the availability of bicycle sizes. If a reschedule is not possible for any reason and the booking is subsequently cancelled, the normal cancellation conditions will apply.

Tour Cancellation Conditions

In cases of any tour that is cancelled by Yellow Velo Inh. Peacock, the customer will be refunded in full.
In cases where the customer fails to show up at the trip start time, cancellation charges will be issued in accordance with the below cancellation terms.

Cancellation conditions for bookings made using the “Individual” ticket price of chf 64.- per person.

In cases of customer cancellations made with over 24 hours’ notice before the trip time – full refunds will be made and no cancellation fees will be charged.
In cases of customer cancellations made within 24 hours’ of the trip time – No refunds will be made as the cancellation fee will be equal to the the full booking amount.
Dates may be rescheduled at any time free of charge at the discretion of Yellow Velo Inh. Peacock. This will depend largely on availability of places and bicycle sizes on the new desired date. If a reschedule is not possible for any reason and the booking is subsequently cancelled, the normal cancellation conditions for individual ticket bookings will apply.

Cancellation conditions for bookings using the “Group” booking price of 8 tickets or more (Ticket price: chf 59.- per person)

In cases of customer cancellations made up to one week (168 hours) before booking date, full refunds will be made and no cancellation fees will be charged.
In cases of customer cancellations made within one week (168 hours) of the trip time, The cancellation fee will be equal to 50% of the full booking amount.
On request by the customer, tour dates may be rescheduled within four days (96 hours) of the trip time free of charge. This will be at the discretion of Yellow Velo Inh. Peacock and will depend largely on availability of tour places and bicycle sizes on the new desired date. If a reschedule is not possible for any reason and the booking is subsequently cancelled, the normal cancellation conditions for group bookings will apply.

Terms and conditions for Yellow Velo bicycle and equipment rentals

Before renting bicycles and equipment from Yellow Velo Inh. Peacock, a responsible individual must read, understand and agree to the following statements.

The contract signee affirms, on their behalf and on behalf of any individuals legally represented by them
or using any of the equipment detailed in the contract with Yellow Velo Inh. Peacock, that they are physically fit and able to operate a bicycle. In cases of uncertainty, the customer is responsible for seeking appropriate guidance from Yellow Velo Inh. Peacock before the contract is signed.
All personal data entered in the rental contract must be correct at the time of signing.
The contract signee takes responsibility for and losses or damage of the equipment detailed in the rental contract during the rental period.
All persons who will be using the bikes and rental equipment must be competent at using that equipment and should be aware of the traffic and road regulations of Switzerland.
Yellow Velo Inh. Peacock has the right to confiscate its rental bikes from customers if the the riding is deemed to be unsafe or if the rider is deemed to be incompetent. In these cases no refund will be made.
Overnight bike rentals must be securely stored under cover.
From the contracted start time until the return of the rental equipment, the signee of the contract is liable for any damage or losses incurred to the rental equipment, and the cost of any necessary repairs (Repair labour costs charged at CHF 100.- per hour).
In case of theft, the signee of the contract must report the theft to the Police and to Yellow Velo Inh. Peacock within 24 hours of the discovery.
Sub-rentals to third parties are not permitted unless previously agreed to by Yellow Velo Inh. Peacock.
Yellow Velo Inh. Peacock does not have the means to collect customers or bikes in the case of break-downs or accidents. It is the customers responsibility to return the bike to the Yellow Velo shop by the end of the working day. If this is absolutely not possible, the bike must be safely locked up and the location of the bike should be noted by the customer.
The rider should visually inspect the rental bike and rental equipment before each use.
By accepting a bike and/or rental equipment, the signee acknowledges having received that equipment free of any damage or defects.
The customer should take out adequate insurance coverage for potential risks related to bicycle use. The customer should understand that they are not insured by Yellow Velo Inh. Peacock for any damages incurred, whether to themselves or to a third party, while receiving services from Yellow Velo Inh. Peacock. Liability of Yellow Velo Inh. Peacock and its personnel is disclaimed to the extent permitted by Swiss law. In all other instances, the liability of Yellow Velo Inh. Peacock is limited to the fees paid by the customer.
The wearing of a helmet is not compulsory when riding a bicycle in Switzerland, but is highly recommended. Bicycle helmets are available to rent for adults and free for anybody under the age of 18.

Rental Return Times

From May to October rental bikes and equipment must be returned by 17:00 on the final day of the rental.

From November to April rental bikes and equipment must be returned by 16:30 on the final day of the rental.

Bikes and equipment returned later than the above times will be charged a fee of CHF 50.- for each 30 minute period.

In case of early returns, refunds may not be made.

Terms and conditions for Yellow Velo online shop

1. Shipping:
Orders made online will be processed and shipped within two working days once we have received the payment. Our bicycles and parts are shipped in quality secure packaging for safe delivery by either Swiss Post or DPD. For exact shipping costs to countries outside of Switzerland please contact us before placing the order.

2. Pricing and Payment:
We accept payments thorough VISA & MASTERCARD
Prices are shown and should be paid in CHF (Swiss Francs).

6. Returns:
You may return your order within 2 weeks of the order placement. For orders returned we will issue you with a full refund excluding shipping cost. The item should be returned to us at your own cost by secure means to ensure it reaches us in exactly the same condition. Returns should be shipped to Yellow Velo, Postgasse 11, 3800 Interlaken, Switzerland. We recommend that you insure the return shipment and that you retain the proof of shipping. As long as the above conditions are all met, refunds will be issued within 30 days of us receiving your return.

3. Bike sizing:
The seat tube length (c-c) length of the seat tube starting at the centre of the bottom bracket and ending at the centre of the top tube.

The top tube length (c-c) is length of the top tube from centre of the seat tube to the centre of the head tube.

4. Transport damages:
Yellow Velo Inh. Peacock is not liable for any damages incurred during transportation. Any disputes over damage incurred during transportation should be taken up directly with the courier company.

5. Reservation:
All products remain the property of Yellow Velo Inh. Peacock until they have been paid for in full.

8. Liability
Yellow Velo Inh. Peacock does not accept responsibility for damages caused during the use of it’s goods, so far as is permitted by Swiss law.

9. Data protection:
In order to process and ship orders, Yellow Velo Inh. Peacock will save your personal information and, when necessary, pass these details on to third parties for this purpose. All personal data is treated in confidence.

10. Second Hand Products
Many of our bicycles and products have been previously used and may be up to 60 years old. While our bikes have all been professionally serviced and checked over by a mechanic (unless otherwise stated), signs of use are to be expected. Please check photos and item descriptions carefully.

Yellow Velo Inh. Peacock Terms and Conditions.

The following statement applies to all of the terms and conditions on this website. Should one or more provisions of this contract be declared invalid or unenforceable, or should a gap be identified, the remaining provisions shall remain valid. Invalid or unenforceable provisions will be interpreted or replaced to best align with the intended purpose of the contract. The same principle applies in cases of contractual gaps.

Any disputes related to the business activities of Yellow Velo Inh. Peacock is under the jurisdiction of Interlaken, Switzerland. Swiss law governs this agreement.
